Confused. Please help.

Hi, I am rather confused and need advice on how to go about this.

I manage the property myself and 6 months ago I put 2 tenants in the property. They seemed like a very nice pair.

I took £150 each/for deposits and placed them into a DPS. The rent was a lot more then that and the property was furnished (it's a flat.)

I downloaded a template from the internet for a AST and they agreed to sign it. I failed on a couple of areas of not getting photo i.d/guarantor i.d (although I did get addresses).

The tenants obligation in the AST are;


The tenant will be responsible for water charges, utility bills and council tax.


TENANT’S OBLIGATIONS


The tenant agrees with the landlord as follows:

(a) to pay the rent as and when it falls due; on 20th of every month until the end of the Tenancy Agreement in advance.
(b) to keep the interior of the premises and the fixtures, fittings, windows and other things, which form part of the premises, in as good a condition as they are in now. The tenant also agrees to make good any wilful damage that is done to the premises during the term of this tenancy;
(c) not to part with possession of the premises or sub-let the whole of the premises;
(d) to use the premises for living in as his/her only or principle home and not to operate a business at the premises without written consent from the landlord;
(e) not to cause or allow members of his/her household or visitors to cause a nuisance/annoyance to neighbours or the neighbourhood;
(f) not to commit or allow members of his household or visitors to commit any form of harassment on the grounds of race, colour, religion, sex, sexuality or disability which may interfere with the peace and comfort of, or cause offence to neighbours;
(g) not to play or allow to be played hi-fi equipment or a musical instrument so loudly that it causes a nuisance or annoyance to neighbours;
(h) not to keep pets in the premises without the landlord’s consent;
(i) to keep the interior of the premises in a good/clean condition and to decorate all internal parts of the premises as frequently as is necessary to keep them in good decorative order;
(j) to undertake any necessary minor repairs to the premises i.e. changing washers on leaking pipes or attending to blocked sinks;
(k) to report to the landlord promptly any defect in or damage to the structure or internal installations of the premises;
(l) to allow the landlord or his agent/employees access at all reasonable hours of the daytime to inspect the condition of the property or to carry out repairs to the premises or adjoining property;
(m) not to assign or sub-let the tenancy and take in lodgers without the landlord’s written consent;
(n) to give the landlord at least four weeks notice in writing to end the tenancy;


Now my problem is this; one of the tenants did say that he would end the tenancy after 6months but it was not definite. So on this basis I created the agreement of a 6months tenancy for the pair.

They have always paid their rent on time by standing order and have never given me any problems what so ever. The flat is messy, but maybe that is in the way of which they like to live.

I received a letter/call from the TLC (tenants letting check), asking for a reference for one of the tenants. They told me he was looking to move, needless to say I gave them the reference and stated that he had not told me that he was leaving. Although I had some idea that he would probably go after the 6months tenancy was up.

Now the tenant who is leaving, I cannot get in contact with him. He has NOT given the last 2 months rent.

The tenancy ended a couple of days a go for both of them and I haven't received any call, or reply to what they're wanting to do next. If the tenants are still there does that mean they're living illegally as the tenancy has ended can I enter the premises without giving the 24hour notice?

How can I chase the non-rent payer, I called the TLC though they could not tell me much apart from they'd contact the people they were doing the reference for and let them know, as one of the conditions of one of the tenants moving into the other property was that the tenant finish his current tenancy agreement with myself.
