I own a Ground Floor flat with a leasehold and also a share of freehold. The guy upstairs owns the other half of the share of freehold.
He has about 5 years ago extended into the loft before I purchased my flat.
I'd like to as a minimum extend the flat and a maximum build a basement and also extend.
I've checked my lease and as long as all the appropriate building and planning regs are adhered to, the lease allows for it and states that share of freeholder consent shouldn't be unreasonably witheld.
My question is what if it is unreasonably witheld? What can I do in that situation? Would I have to go to the LVT? The reason I ask is, the guy is a 100% moron! As an example, he's objected to a guy 5-6 doors down doing the same thing! I don't know why! Maybe jealousy! Who knows!
Anyway, as the song says, I predict a riot! But I want to extend and/or build a basement as I need the space and I live in a nice area and can't afford to buy a house in the area, which of course would be the easy option!
