Sorry about the Long post (needed to explain in detail so it makes sense)
Just before Christmas i found a property using Zoopla. I contacted the Agent and arranged a Viewing. I liked the property as i needed a family home asmy wife is expecting any day now so need a bigger place and be settled.
I paid the estate agent 350 holding deposit the same day.
Next day i went in with the required paperwork. I initially was told 1 months rent and 1 months depo. However after looking at my savings statement which was in the excess of £20,000 they decided to bump it up to 1 month rent 6 weeks depo...
Since my wife liked the property i said go ahead. Gave all the referencing paperwork and was told i will hear back if the landlord agrees.
Never having a problem moving in anywhere else i was expecting to get the property.
I saw the property on a Wednesday and proposed moving was the following Monday.
Anyways after two days I heard back from them saying yes landlord is happy. Subject to referencing. Ok i understand. Referencing came back from RentGuard the following day. for both me and my wife (when my salary was more than suffienct enough to cover the rent). The referencing was ALL OK! I even saw it with my eyes when i went back to the estate agent he showed me a copy of the referencing paper from RentGuard.
Got a phone call from the Estate Agent. "just spoke to the landloard he is all happy to go ahead please come in to the office and bring the balance"
I was all happy and paid the reminder 6 weeks depo and 1 months Rent in addition to the 350 i already paid.
Then me and my wife both SIGNED a Tenancy agrement and witnessed by the Estate agent. (I still have this)
Monday came..
Sorry the landlord wants to come down and meet you guys on Saturday before you move in...
I already agreed with my current landlord that i would be out by wednesday.
Because the Estate agent reassured me that moving in my Monday would be no problem.
Anyways i had no choice but to stay in my in-laws! (Slept on the bloody sofa)
With my paperwork i submitted a written reference from my previous landlord
It had his phone number on it.
Now This is what the Estate Agent tells me the Landlord Said. (Even dough all my referencing came back ok from RentGuard (they did a enhance referencing for both me and my wife) (Contacted my employer, checked bank details etc)
In this period, till Saturday He phoned that number and someone picked up saying they are not the landlord!?
I mean i was confused when i heard this. I know people give fake references but if i was to do this i would make sure the person on the other end picking up the phone knows whats going on?
Being surprised by this i phoned the number my self. Someone else picked up i asked for my Landlord and he said his not using this number at the moment because of the holidays. I explained the situation that the estate agent is trying to contact my landlord etc.. and managed to get my landlord to call me from his personal number...
Right so I got my landlord to call the Estate Agent directly...
They spoke to him.
The new landlord said do the referencing again... The company RentGuard then contacted my old landlord and says we have done and land search registry and it doesn't show you as the landlord etc
I was like to the estate agent thats none of my business you deal with that with him.. I pay rent to a guy every month and my bank statement showed it same guy as on the referencing.
Whether his subletting to me or what i dont know.
Anyways then the new landlord askes for personal stuff. Such as my Marriage certificate and askes the estate agent if my wife is really pregnant or not? Lol She is 8 1/2 months its not easily hide able that she is not.
Anyways because of this i said cancel this deal your taking the mick asking me personal stuff like that...
They gave me my 6 weeks depo and 1 months rent (even dough i had to argue to get this back)
Now they go to me they cant refund my 350 because i failed referencing because of my landlord...
My point being they made and my wife sign a Tenancy agreement took our money and mucked me about...
Never been really homeless now i am staying at my in laws whilst i look for another property. But with a pregnant wife i am outraged by their behaviour of something that was out of my control.
Any advised would be greatly appreciated on getting this holding depo back. As they pulled out not me i was more than happy to go for it and comply'ed all the way thru.
