Claiming for damp caused by tenants not ventilating flat

Hi,

New member so go easy.

We've been renting a flat out for the past 18 months and the tenants are about to move out. Now that they've removed there stuff there are a few damp patches that need to be repaired. Our builder says it's not rising damp and does not need a damp proof course. It is caused by poor ventilation.

We know that the tenants used the radiators to dry their clothes and hardly ever opened the windows so we would like to claim for the re-paint. We think this is reasonable given the flat was painted before the tenants moved in.

I have a feeling the tenants will kick up a fuss. Do you think we have case given that the DPS more often than not side with the tenant?

Any advice greatly appreciated
