section timing

Hi
I served a tenant with a section 21 notice within his fixed term last year, as he was always messing me about with the rent etc, but then we had a chat and he said he would pay on time, usual story, fast forward several moths later and he's not paying again;

1) Will the original section 21 stand?
2) What notice now do I have to now give him?
