I am living in UK and my landlady in USA.
My girlfriend and me signed a contract for a flat from 28th September 2012 to 28th September 2013 (Assured Shorthold Tenancy). My girlfriend had to come back to china and she won't come back. Well, I can't afford the rent by my self and I would like to move out in the next 28th February.
We live in a flat, but the whole building belongs to the same landlady. So, there are upstairs 4 more tenants (renting rooms) but we don't share any water bill, anything. So there are different properties in fact.
Here we go. We had a lot of problems with the Landlady because she didn't put the deposit in a DPS. One of the tenants upstairs left the house because she didn't put the deposit in a DPS, so this tenant (who paid two months deposit) was two months without pay any rent and left the property.
Some days ago (yes, after 4 months) she sent us a mail with some photos about the DPS. Well. She sent it to the tenants upstairs and us. In this papers just appear the name of one guy from upstairs (lead tenant I thing it is called) and the full amount (like £2400). Then I was wondering how can I know how much of this money will belong to me because my girlfriend and me paid £1220 of deposit and the tenants upstairs like 450 each or less. We didn't discussed about this, about to put all the money together and about who will be the lead tenant.
Moreover, I have called to this DPS business and the said my name doesnt appear in it. Just my girlfriend's name (we signed the contact together. Two names in the contract).
I am looking for a tenant replacement to get back my deposit, but I am afraid I am not protected and I don't know what I can do.
I have to say I had a replacement tenant, but the landlady asked him for a lot of money (£100 service fee but I was the only one who showed the flat and set up the advertisement about). I thing she is putting many troubles to find a replacement tenant.
So I don't really know what to do.
I am afraid she will make in the future a deal with the lead tenant to don't give back the money to the other tenants (in the past she didn't protect the money of the last tenants, and at the end of their tenancy she took like £100 of each deposit to clean the rooms and the kitchen they share. But in fact nobody was cleaning it).
