Help needed please..

Hi all

any advice / help would be greatfully received.

My tenant was issued a section 8 & 21 notice by my local council in Middlesbrough, due to noise complaints and regular issues at my property with police, parties, drugs etc. Also the tenant stopped paying me in August 2012. She was 8 weeks in arrears when the the orders were placed, but due to an error with the council paperwork, the dates were wrong and they had to be re-issued again. I was strongly advised to let my tenant stay in the flat until the section 21 date which is tomorrow (22nd Jan 2012).

Also she and her partner have damaged all the carperts, kitchen units / drawers, both front and back doors wont lock and have been kicked in, the bath is broke, garden has never been maintained, and now looks like a jungle, and she is smoking in the property - which all goes against the agreement, which is over a year out of date, as she refused to arrange to sign a new one. Whenever we tried to arrange to pop in, she would say she or her baby was ill. This includes - more recently for us to complete a gas check and repair of the doors etc. We just simply cant attend, and have been advised to 'stop harrasing her'.

Her solicitor (free legal aid no doubt) has sent two letters, one stating we were harrasing her - this was for asking to inspect the flat and wondered if she would pay any cash. They also advised she offered to top up £60 per month to top up the cash we receive from her housing benefits, which are now paid direct to us. This clearly wasnt the case as she refuses to speak to us or answer the door, letters, texts and calls.

The 2nd letter was to advise us that she wont be leaving on the or after 22nd Jan. They state the s21 is invalid, due to the FACT she never paid a deposit, and always promised she would, and never did. We have had this checked by housing association in Middlesbrough, as well as housing at the council, and they both feel there is no evidence to state she did or didnt pay the deposit. The original receipt signed by myself and tenant states £450 rent and £150 - for a sofa we no longer needed.

Having read into this non-stop on the net the advice under s21 is that the deposit should be in a tenancy deposit scheme... how does this work when she never actually paid us ?

I REALLY need help, as I cant afford a solicitor, and am at serious risk of losing the flat if she stays there as I simply cannot afford to pay the mortgage, and be down on cash every month. This is seriously making myself and partner ill, and I feel helpless. I also need to move back in, as I can no longer afford the property I rent.

HELP...
