Got a tough LL here, who wishes to charge £575 for alleged cleaning and repairs. Now, I accept £33 of the charge as we paid rent a day short upon the expiry of the agreement, but the other is completely unfair. Our landlord never pointed us the damage upon leaving and I never recall them at all. I don't see how these charges have come about.
The situation is that we have £1000 held with the DPS and we need the monies or at least a partial payment. I therefore initiated a dispute through the DPS via applying for the ADR. The LL in questioned refused this.
Thus it leaves us in an awkward position. The LL has thrown defamatory remarks toward me and has ignored emails and calls.
Thus my question is that as the LL refuses to use the ADR, am I in a position to accept his charges through the DPS, releasing the remainder of the deposit, then I could apply to the small claims to get the remainder back?
Very stressful all this I must say. I would appreciate any help or advice.
