I own a property that is rented out, a shop below and a flat above, the tenant in the flat is a regulated one. Following some routine repairs to a chimney the builder told me that someone in the property has been urinating out of the window on to the flat roof of an extension, apparently it seems this has been carrying on for a while due to the staining on the flat roof, the smell was so rancid the builder refused to finish other jobs near this area, the gutters are full of urine as the gutter is blocked by some vegetation, below on the ground floor is rear access to the shop which prepares food and sells it, the lady who runs the shop is unaware of this problem above, Is this a breach of the regulated tenancy due to deliberate damage to the property? Should I tell the three lady's that run and own the shop? Should I get a specialist cleaner in and bill the tenant?
