I seek your help and advice on this matter please..
1. I served section 21(4)a on a periodic tenancy to my tenant . Notice expiring 21st March 2013. The notice was served correctly by post and by hand with witness.
2. 2 days before the expiry of the notice , the tenants wife sent me an email saying that he is not in the country and she would clear all the rent arrears if we let her stay another month until April.
3. I informed her , I would need to seek advise to extend the tenancy . However she should pay up all the rent arrears asap. I did not commit to any extension of tenancy.
4. She kept saying she would pay as soon as he comes back home , but nothing was paid. The tenant himself is not in the country and is not responding to any emails or letters or phone calls.
5. Now the wife is also not responding to any emails to pay her outstanding rent.
6. They have not paid any rent since January 2013.
7. Can someone advise me what is the next best step ?
Whilst browsing through the forum posts , I understand that I can seek claim for possession under Section 21 . If so , what is the best way forward ?
