Okay this is my issue:
I have been renting out a house as a landlord and the ASSURED SHORTHOLD TENANCY AGREEMENT runs out this Monday at midnight through "Estate Agent A". I served notice 2 months ago as advised as I sold the property. The buyer was desperate to take the tenant on as he has been a good tenant and we had agreed verbally to complete by this date some time ago. However my solicitor said that the buyer is not in a position to complete for up to2 weeks as an estimate due to finances not being finalised yet.
To set the context to my main problem I got my tenant from "agent a" one year ago, but the person buying the house who wants the tenant is using a different agent, I believe its the agent I sold the house through although I do not know for certain. My contract says that it will automatically become a periodic tenancy with rent payable on the 14th of each month to the landlord. If it goes beyond this date I will have no choice but to collect rent and tell the original "agent a" that it is extended on a rolling basis and pay whatever fee they say? Then arrange with my solicitor the exact implications of this ... when I said I need to know what to do if it breaches this date my solictor said don't worry it will all go through before this. To be honest I am annoyed with them, shouldn't they have offered better advice and all this sort of fine detail be completed my them concerning the transfer of tenant? I was told after calling the solictor on Friday afternoon that I will need to seek an extension from Agent A. A concern is can letting "agent B" essentially take the tenant over for the buyer. "Agent A" knows I'm selling the house but its unlikely they know i'm selling the house with the tenant in as I was told this was okay but now I have doubts ... The problem is I don't get impartial advice from either agent and my regular solicitor is on holiday for 2 weeks and the person dealing with I am not overly confident in.
One small mercy is my tenant is reasonable and wants to stay within the property regardless of who is the landlord and has been consulted throughout the sale but is probably unsure what is going on at the moment, as am I!
All in all I'm pretty gutted how this has panned out as I have been chasing everyone for 2 weeks. I'm now left totally confused with the legal implications, please accept my apology as this started to turn into a ramble! Thank you if anyone is able to offer any guidance.
