Hi, newby in need of advice please!
Where to start...
Tenants ok, a few problems with payment, same MO every time - suddenly no payment, then there's an issue that needs to be resolved, yesterday. She's withheld a ports she feels fits before, I've tried to evict before, but she has free legal representation as she's on benefits and, ling story short, I was temporarily unable to evict on a technicality and sat down to resolve some issues with her partner and gave up as the whole process caused me so much stress.
Then, suddenly this year, aft non payment..again, she sent me a text telling me there was a rodent issue and that she was contacting environmental health. They had been to the property a year before (general issue in the area) and set traps etc, recommended some improvements in structure of the property, which were completed. As she didn't ask me to do anything, I just replied 'ok' 3 days later I had an aggressive text telling me I need to 'shape up and sort out the issue' I called and asked exactly what she wanted me to do. I went to the property, checked the attack, crevices and found no signs of rodents, but nevertheless, told her I would secure any weak points in the building as soon as I could find someone to do it. Less than 4 days later I contacted her to arrange a date for that week. No answer to my te ts, calls and when I visited the prey, the family had gone! A week after the payment date, without paying.
She is now demanding the bond back, stating that she was advised by citizens advice to leave immediately! And has sent a solicitors letter demanding repayment. Can she do this?
