I Wonder if anyone could give me a bit of advice our downstairs neighbor owns her flat whereas we rent ours from a letting agency and have been her over 4 years now. Our tenancy agreement states that we have use of theshared garden, my problem is that the downstairs neighbour dominates the garden and believes that it is hers - we aren't even allowed to hang washing out in it. Other shared areas include the front garden and hallway. I have recently purchased a bike which I keep chained at the front of theproperty as she refuses for me to place the bike in the shared back garden even though it clearly states on the tenancy agreement that it is shared. When I owned a bike previously to that she told me to keep it in the hallway now I am aware that our letting agency do not like this as the is obviously a fire exit. Her excuse for wanting me to move the bike is that it is spoiling the outlook for her cat. She has also over the past 4years sent us note on a variety of petty things - window boxes the dirt falling onto hers, she claimed the sky man put a hole in her wall which hedid not. Accused us of making noise in the day which is impossible as mypartner and I both work, moaned about the front door opening as we were loading the car, said the back steps that were leading to the garden from our flat were going to collapse (our letting agency came and check this and said that this was rubbish). Also at the top of the stairs she asked us not to put a mop and bucket because she felt it would cause the stairsto collapse? (yes a standard plastic bucket and mop.
Can someone also let me know how I stand about asking for the back gardento be split 50/50 (all the other flats in our road have the garden split so that the upstairs and downstairs flats have equal amounts of the garden, this would then allow me to store my bike in our part of the garden!
I know that you can't stop petty people like her, but both my partner and I are actually quiet considerate neighbour, we don't make much noise and or have a barking dog or child running around and even when we have had visitors they haven't caused that much noise - I am in my late 30's and my partner in his 40's so we are responsible adults, who are considerate.
