Moneyclaim Online .. Please help ...

Hi All ,

I am under a lot of stress with my tenant who just wouldn't pay , and is planning a runner. I would be very grateful for your advise please ..

I am planning to do a Moneyclaim whilst waiting for the Section 21 to expire.

My tenant is in 3 months rent arrears . Rent paid monthly , on the 1st of every month.

Please could you advise -

1. For the amount of debt . Can I start the claim anytime of the month , with all the rent due until the 1st of that month ?(as rent is paid in advance for the month or do I have to calculate rent on a daily basis ? ) eg- can I start claim on 10th July with all the amount she owes until the 1st July ? since rent is payable on 1st July ? or do I have to pro rata it to the date I am making the claim ?

2. My AST states that the overdue rental payments will be subject to interest (calculated from day to day) at the rate of 5% over the B O England rate , calculated from the date the payment was due , until the date the payment is received.
Does anyone know how can I calculate this ?

3. If the total amount of my claim exceeds £3000 however I would only like to make £3000 of claim . Can I do that ?
And add the rest of the balance with other future debt that the tenant owes by the time he leaves the property (by the time I get Posession Order) .

I do not have much hope of receiving my cash back , but I am hoping that I can do my claim before tenant does a runner .

I would really appreciate your help.
