I need to give my tenant notice to leave as she is in arrears with her rent. She has agreed to leave but I know this could change when she actually has her notice so I want to make sure I do the right thing in case I have to take her to court. I've read loads of stuff but I think I've now confused myself! She is outside the initial 6 month tenancy agreement, so now just a periodic one, so I thought the easiest way would be a section 21 notice. However, I haven't paid her deposit into a deposit scheme so this now seems a 'no go'. She has been short on her rent since February, but her total arrears haven't reached 2 months worth yet as she is on housing benefit (although she will do by her next rent due date). She has also breached other conditions of her tenancy by changing the locks and not providing us with keys, not allowing us access for inspection etc. I want to just send her a letter giving her a date by which to leave, but it seems a section 8 notice may be my only option. Am I correct in this?
