Lender requirement of a new SaT (=AST) when tenancy is periodic..

Dear all..

Think the heat must be making me (even more than usually..) grumpy: Albeit I'm in the Scottish Highlands & there's still snow on the hills...

In process of trying to mortgage a currently unmortgaged property. Would have thought I'm prime target as a safe person to lend to 65, multiple pensions, money in bank, good tenants paying regularly,,, (yeah, but they all say that...) - but that's not the issue..

The lender is saying the current (Scottish SaT, v v v similar to English AST) tenancy is not acceptable as " ....this is unsatisfactory as the tenancy agreement ended on dd/mm/2013. " & I must get a new one: Ignoring the clause that says it carries on month-by-month. Now I'm not happy about (attempting) to force an otherwise excellent tenant to sign a new agreement - and can't see the ethical or business justification for this: Don't these chaps know tenancies roll on & the law does not permit that not to happen??

Suggestions how to proceed (I will of course calmly & politely write & explain the legalities but expect this not to meet the criteria they have..).
