I let out my property in Nov-2011 and did not protect the deposit with DPS. Beat me for this as it was my carelessness. I have learnt the new Localism rule and will abide by it in future. I did protect the deposit, late though, after the Tenant chased me for deposit-id, sometimes in November-2012. The tenancy ended in May-2013 and now the tenant has sent me a letter claiming 3x the deposit as I flouted the the statutory obligation of protecting the deposit within 30 days of receiving it.
What are the possible points I can make in court so as to reduce partially if not fully waive off the fine?
The tenant has always been late by a few days in paying the rent. Will that help? Any similar point you could suggest please, it would be of great help.
Again, as I said, I will abide by the rules in future, so please be generous in suggesting the points I asked above.
