Recently paid a holding deposit of £350 for a property, plus agent fees of £200. Agent fees were clearly laid out before we paid, including credit checks, admin fees, check out fees etc.
After holding deposit and agent fees were paid, and credit checks came back, I was sent over a draft tenancy agreement/contract.
Contract included a clause stating professional cleaning receipts were required at the end of the tenancy. Quick look at quotes online shows this would cost about £200.
I flagged this up with the agent, saying I wanted this clause removed as I am quite capable of cleaning myself and handing the property back in the same state.
Long story short, the tenancy fell through as the landlord insisted on this clause.
Can I reasonably expect a full refund of the holding deposit and tenancy fees that were paid?
I have a signed tenancy offer sheet stating the commencement date, the term and the monthly rent. I also have the agency fees clearly listed, and neither mention professional cleaning receipts/fees were required.
Of course the agency does not want to refund this as they say I pulled out of the deal. My stance is that the landlord pulled out, as I was happy to proceed but without signing the contract with that clause.
Any advice greatly appreciated :)
