Overpayment and part-month

Hi,

I was wondering if you could help me with a very unfortunate situation in which we've found ourselves.

We recently gave notice to our landlord that we were due to be leaving the property. We gave our notice on the 29th of June and advise we would like to leave the property on the 12th of August, giving plenty on notice. Our land lord replied saying he was flexible on moving out dates, that we needed to give a full notice (which we had) but that if we wanted to stay longer we could do a part-month.

Unfortunately, we forgot to cancel our standing order for the part month and so when we realised our mistake, we contacted the landlord to explain and ask for the part payment back. At first he was reluctant saying he wouldn't do it but after we said he'd previously agreed to this, he rescinded and agreed to pay the money back minues £100 for carpet cleaning.

We said we'd agree to this but felt that £100 for a 1 bed flat (loung dinner, hallway and bedroom are carpeted) was quite a lot especially considereing we'd only been in the property for 6 months. He has now flown off the handle and said the costs for cleaning the carpet are now £150 and that he won't give the part month payment back. At no time was carpet cleaning mentioned when moving in and it is not in any contracts or paperwork. We have had independent quotes of £55 for the cleaning (not that it really needs doing!)

We have all the correspondence in writing (emails), which includes his agreement on a partmonth and his escalating cost of cleaning.

I feel that he's pulling a fast one and we're entitled to our overpayment back and that we shouldn't be liable for such a extortionate cleaning bill.

Any advise would be very much appreciated.
