Hi everyone, hope someone will be able to help me out here.
I have accepted an offer to sale my leasehold flat eight months ago, but my freeholder's agent refused to answer my solicitor's pre-sale questions to complete the sale. He is asking for more then £3000 to repair the building, otherwise he will not provide the information we needed to complete the sale.
We contacted this agent for 3 months to resolve this problem, but no reply from him whatsoever, therefore, we had to take him to LVT to resolve this matter. The decision from LVT declared that we do not need to pay this agent any money and set an upper cap for this year service charge to £250.
Despite the decision from LVT, he still not providing information to our solicitor to proceed with the sale, instead, he is asking us to pay for last 15 years service charges ( which is also more then £3000 ). We have found out that we do not need to pay any service charge for more then 18 months. ( By the way, he has not done any work on this building since we moved in 9 years ago. Yes, we moved in 9 years ago, but he tried to charge us for 15 years, this is how unreasonable he is. )
Does anyone got any suggestion what we can / should do? As the buyer of our flat has been waiting for 8 months already, the buyer might withdraw his offer as it has been taken so long to complete.
