This may not be complicated to you kind people but as a newbie landlord I am a bit lost...
I bought my one and only rental house a while ago with tennants in place and the rent was all paid for by the company they worked for so everything was amazing and easy (hence my not being very experienced) and I was gutted when they gave notice to leave..
So, I had a close family friend who wanted to rent the property and it suited me as it meant I didnt need to redecorate and fit a new bathroom (which I think I would have done to get new tennants in) and being a good friend I know I can trust him... Anyway... I was fully aware that most the rent would be paid for by housing benefit and he would pay me the extra to make it up to the full amount.
He moved in on 17 June 2013 and paid me the difference from the housing benefit to the actual rent as agreed and has done so since... now he has been told he wont be getting housing benefit as the local authority claim he is only in the house to take advantage of the housing benefit..
So.... In order to help prove this isnt the case I need to start sending out the formal letters... I will be posting out letters regarding the outstanding rent so he can show them to the housing people but I dont know when I can actually serve the section 8..
He moved in 17 June and the rent is £425 per month (£300 of which should be paid for by the housing benefit).. So far he has paid me £340 out of the total of £1046 that shoudl have been paid.. so although he has been in there 2 month and 2 weeks he has paid almost a full months rent... Does this mean I cant issue a section 8 yet as I dont actually have 2 full months unpaid??? in which case am I now better of asking him to not pay me anyhting more so that I can issue the section 8??
just to point out that this section 8 will no be a problem.. he has already said he will move out if he cant get the housing benefit and sort out the outstanding rent at some point (which I am happpy with as I owe him for so many things he has done for me in the past)
So this is really just to help him prove he is not gaming the system and that as a 42yr old man he needed to leave his mum and dads house and get his own place.. The housing benefit people only have an issue because he was honest and told them he was renting from a friend......
