Our dispute is currently being adjudicated on by the ADR of the DPS, as the landlord is trying to claim his property was left in a dilapidated state so needs the deposit to sort it out. We say, and the inventory photos show otherwise.
We've just been forwarded a copy of the landlord's/letting agent's final comments and they are a pack of lies! They claim the septic tank was our responsibility when it is not mentioned in the agreement, they claim we weren't allowed to run a business and really pile it on as it was never removed from the agreement (we stupidly didn't pick up on it) but they expected us to secure and waterproof the garage which would be turned into a workshop - the landlords drove past the property on a daily bases when we were working, and knew full well that it was one of the only reasons we moved into the place - there were far better properties out there for the same price but didn't have the work space.
The letting agents are lying through their teeth and it feels like we've now got our hands tied round our backs - how do we have any recourse against the lies which we can prove with a bit of time - we've submitted absolutely tonnes of evidence to discount them, but how were we supposed to defend ourselves when they get final say?
The judgement is due in 9 days time and I know it is going to go against us due to the lies. Is there an appeal, can it go higher up?
Is there anything we can do as this has left me reeling...
