Just want a bit of advice - since the new changes in the housing benefits scheme/cap have come in place, i've been receiving less rent for my property which i'm currently letting.
The current contacted rent is £1150, but I receive their maximum benefit which is £925. I therefore a few weeks ago asked for possession of the property back through my lettings agent. Reasons for the reposession of the property is that firstly i'm not getting the full rent and would rather rent it privately to achieve the maximum, and secondly I wish to convert the house to two single bedroom flats after about 6 months time.
Section 21 was signed at the start of the contract as i kept a copy and also gave a copy of it to the tenant (This was not dated). I've applied for the court and in his defence he's written that the section 21 that i gave him has not got his signature on it (which i cannot remember him doing/me getting him to do it).
It looks like this matter is going to go to court - how likely/what is my position for getting the property back anytime soon, and what is my exact position at the moment.
