I've recently moved into a new letting, and there is an issue with one of the windows:
This is a sash window which would have been installed pre-2002. The concerns that we have are with providing ventilation for the room otherwise being faced with excess heat, and having a point of escape in the event of a fire. The window is on the first floor of the property. At this point I'm looking to take a temperature reading in the room, and make my concerns known to the letting agency to give them a chance to make a recommendation to the landlord that we should indeed have the freedom to open the window.
It seems like an unreasonable and unnecessary restriction to me, so I would appreciate feedback on the best course of action to take, what regulations can force their hand, and if anyone can think of any reason why the landlord would not want the windows opened.

- Landlord had the window painted shut deliberately and refuses to have it unblocked so that it can't be opened
