I entered into an ASTfor a period of 6 months on 21st April (expires 20th Oct). Due to past experience I assumed that the tenant was always only liable to provide 1 months notice if they either didn't want to continue beyond the initial 6 months, or, if we had already gone onto a statutory periodic tenancy 1 months on the anniversary of the rent date.
Our agent has already asked us if we intend to sign for another 6 months in Oct and we said no as we are buying a house and would therefore prefer to go onto SPT. I have now received confirmation letter from the agent advising that in Oct it will revert to a periodic agreement and we will be required to give the Landlord TWO MONTHS NOTICE should we wish to vacate.
On reading this I quickly pulled out the tenancy agreement and have found the following....
'If the tenant intends to vacate at the end of the fixed term, or at any later date, he agrees to give the Landlord at least 2 months notice'
'While the tenancy is periodic two months written notice is required to end the tenancy'.
This will make our house purchase a lengthy process as we cannot give notice until we have exchanged contracts at which point we will then have to give 2 months notice.
Perhaps I should have noticed this but I thought the terms for notice periods in AST's were standard.
Can anyone advise whether we have any grounds to insist we only have to give 1 months notice?
