Selling a tenanted residential property

Hi

I am currently in the process of selling my house which is currently tenanted.

The buyer is happy to take on the tenants but wishes to raise the rent a little. I made the tenants aware of the potential sale some weeks ago but at that time the buyer wasnt sure whether they would want the tenants to remain.

In the meantime my tenants have gone in search of pastures new and found something up for rent which is like mine a 5 bedroom property because they have a big family. There aren't very many 5 beds available locally and so I can see why they have done what they have done.

However, the buyer has informed them she wants to carry on renting out the house but with a new higher rent - not that it matters but this is still cheaper than the rent on the other property they have seen.

My tenant has today informed me verbally that she wants to move on the 28th of November and that a lady at the estate agency who hold the bond has told her that because it being sold the tenancy agreement is not valid!! (This is the estate agency that originally marketed my house and charged me for doing so before taking two finders fees over the last 3 years( so 2 months rent)when with no sale I decided to rent it (we have had 2 tenants in during this time).

What irks me is the estate agency is now seemingly telling my tenant that she can go without any formal notice because of the impending sale. Is this right?
