My tenant is currently within a 12 month AST which ends on 1st October 2013. There is a mutual break clause within the tenancy which allows either party to end the lease on 1st April 2013.
I have a very good relationship with my tenant, and I have unofficially informed her that we will be moving back into the property at some point next year. She has gone to the council to try to get on the housing list, and they have asked for confirmation of when the lease ends. I have told her I can confirm the lease ends on 1st October or could end as soon as 1st April.
However, if my tenant was happy to leave on a particular date (let's say 15th March 2013), could I create a new 4 month AST that ends on 15th March if both parties agree? Would it be legal and would it definately supersede the current AST? Thank you
