If there are 6 flats in a building and 6 leases and each of those leases states "that every lease of a flat at the Building granted by the Lessor before or after the date hereof contains covenants to be observed and performed by the Lessee thereof similar to those contained in the Lease" can an individual lease be changed without permission of all the leaseholders?
What about waiver of a particular covenant? Would other leaseholders need to agree?
What about a clause that relates to a LL giving written permission to sublet? This is not a covenant that is observed and performed by the Lessee, so does it escape the requirement of being similar in all leases?
