I looked through the forum but could not find an answer to my problem.
I bought a leasehold flat from a developer 3 years ago. The leasehold agreement is between me and the Developer. We had a dog at that time and still have. The dog is not destructive at all. The lease agreements states no pets but we did not read the whole agreement before as the Sales Agent said that the dog will be fine.
There are many pets in other flats also not destructive.
Recently the new property managing company was appointed and they sent us a 'welcome pack' which stated all the things we can't do with the flat. One of the terms were that we can't keep pets without consent. Today we received a letter (only to our flat not to others) to remove the dog. As far as I am aware thre were no complaints from others as in our block of flats thre area 3 more dogs and 2 cats and some squirells. The letter said that they know we have a dog but did not state that there was complaint but only that we are in breach of the lease. I am not sure why they sent letter to us and not to others?
Should I relpy and ask for consent? What is best to do now?
The Office of Unfair Trading states in "Guidance on unfair terms in tenancy agreements" that statement of "no pets" is "Such a term has been considered unfair under comparable legislation in another EU member state because it could prevent a tenant keeping a goldfish."
Should I contact a Solicitor? if yes? how I find one?
Or should I contact the Developer and speak first to them?
