I wish to serve an s21 to the tenant (s) of my property on sunday.
They are an unmarried couple with a child and i have both of there names on the AST which expired over two years ago.
The female tenant claims that the male moved out over a year ago and is now claiming housing benefit as a single mother.I know from reliable sources that he still lives there but of course cannot prove it.
I did not give her another AST in her sole name.
My question is should i address the S21 to both of them or just the female that i know is definately there. I have never received anything in writing to confirm he was leaving and only have it verbally from her.
My worry is that if there are two names on the AST and only one name on the S21then a judge may question it if i have to apply for possesion.
I do not expect her to leave without a fight and do not want to create problems for myself at a later date.
Any advice would be gratefully received.
