Deposit Protection Scheme HELP!!

Hi..
I have taken over the running of a couple of properties from my retired mother. I need to evict a tenant as they have stopped paying the rent. However my mother did not protect the deposit in an approved scheme. Can anyone offer advice as to what to do here??
