New here - apologies for my first post asking for help!
Rented my cottage out on a 6 month AST. Served a Section 21 notice in October requiring possession at the end of this month.
Tenant and Boyfriend moved in (Tenant is the only one on the AST), she is being quite helpful. However, they split up at xmas. Boyfriend stayed there and decided to take on paying the rent. She moved out. Getting rent has been a nightmare (very close to serving County Court papers a couple of months ago).
Where do I stand here. She wants the tenancy to end. He is apparantly overseas. His stuff is in the house. Her and I want to meet at the end of the month and finish the tenancy normally.
My thoughts were to:
1. Turn up at end of month with the girl on the tenancy agreement.
2. If he is not in, gain access. She can recover some personal stuff he hasnt returned.
3. Change locks
4. Put his stuff (if its still there) in storage - I've actually suggested to her to remove his stuff personally.
5. Take cost of locks and any unpaids out of the deposit. She can then ensure all is paid before giving him his stuff back and recovering the deposit from me.
Question is, does he have any legal rights? He hasnt signed the AST, the deposit isnt registered/insured in his name (its in hers) etc?
