Section 8 Court Hearing

Hi Everyone,

I have completed a possession claim online to evict my tenant who is over two months in rent arrears (section 8). Unfortunately I will be on holiday on the given court date (doesn't tell you until you submit the form). Can someone else, such as my Dad, represent my case in court or is it a legal requirement that I attend in person?

I suspect that the tenant may lodge a fictitious defence aimed at causing a delay or dismissal to possession proceedings. What type of information can be prepared in advance to meet such counter claims?

I also served a section 21 notice at the same time as the section 8. When would I be able to start the accelerated possession procedure should the section 8 procedure not work out?
