Can anyone please help?
My ex girlfriend lives in a property owned by a housing trust. She has lived there since 1990 when it was owned by a local council and in 2006 the property was transferred to a brand new housing trust (they had financial issues).
She had an electrical test 5-6 years ago when it was flagged up she needed a new consumer unit which was duly fitted by them and it then passed the test.
In the last 3 weeks she has received a letter stating that her house was due for a full rewire due to planned maintenence in her area. I've contacted them and asked why this is and the response on 3 occasions was that this is the law and covered by the Health and Safety act. They can't tell me what law though! They have offered her £200 to redecorate the house from top to bottom as well as retile the kitchen! We had a kitchen fitted in approx 2003 at a cost of approx £4-5000 as we were about to purchase the property. Sadly we split and she remained a tenant. I think this offer is woefully inadequate but they are refusing to even entertain a higher offer. They sent a contractor round today to assess the work ( a visual inspection) and he stated that he would removed the kitchen but would not refit it as it is not standard. I rang the trust and they said as she didn't ask permission to install the kitchen this was correct! The kitchen was installed prior to the trust even being set up and owning the property and permission was granted from the previous landlord and is still in absolutely beautiful condition.
Can they do that?? We also installed low voltage lighting, an electric shower and underfloor heating in the kitchen, all of which passed the previous test.
She has a two year old boy. This little lad suffers from asthma and the contractor also stated they would be using some sort of two bladed cutter to cut down the walls and there would be lots of dust so she was to make preparations for that. Not sure how she can do that though!
I rang the trust to complain and they said it WAS happening and it wasn't something my ex could refuse, that she had signed a tenancy agreement so they could force entry if they wanted to and generally really scared her! I'm now fuming and am wondering what law(s) this comes under and are they in fact correct in their statements or are they bullying?
By the way they haven't done an electrical test but have stated verbally that her electrics are deemed unsafe as the wires are the wrong colours, whatever that means!
