Ive been presented with a case to advise on. To try and summarise, its concerning two long term protected tenants residing in very sub standard accommdation.
The two tenants do not live in self contained accommodation - they share a flat over two floors. They have a floor each.
In order to attend to the works one of the proposals by the Council would be to self contain the property, so making two self contained flats.
How would this affect their tenancies? I understand it could dramatically increase the registered rent - but the Council is worried it may demote or change their tenancies. My understanding is that they are tenants already (as they have exclusive possesion of part of the premises - L lives elsewhere) and self containing the flat would not demote their tenancy. They would still be considered protected tenants.
Is this correct?
