I am wondering if you can help me with an issue I have with a flat which I manage. It is a group of 5 tenants, one of which has her boyfriend staying with her and causing problems within the flat. The group who do not like him say he is living in the flat but the girlfriend just says he is staying there until he finds a place of his own. Is this subletting? I really do not wish to get involved nor think I should as its a tenant on tenant dispute but the Guarantors are putting pressure on me to help them remove him from the flat.
Where do I stand legally?
Please see excerpt from an email I received from one of the tenants voicing her concern:
(said boyfriend) is living here rent free every single day and it is causing so much unnecessary stress and problems in the flat. He is aggressive and threatening (e.g he threatened to smash my teeth in because I told him he was rude) and it's making everybody uncomfortable and on edge when he is here. He doesn't contribute to the bills we pay and he is so inconsiderate when he is here. He has been seen smoking inside, using drugs in the flat, planning to get a dog and don't feel any way about breaking or wrecking anything in the flat.
We really don't know what more to do. We are constantly worried about what we might have done that may have annoyed him, or whether or not he is in a bad mood and what repercussions there are going to be. I hope you can understand that this is really no way to live and we hate that the fact we were so happy in the flat before and now it is ruined because of the way he acts. We have asked him to move out several times but have gotten nowhere and we don't know what we can do anymore.
I have advised they speak with the police and citizens advice as well as talking with the tenant who's boyfriend this is.
Anyway, any help would be greatly appreciated!
