Hope you're not all enjoying the sun so much that you can't answer my few questions about my rental property
Timeline for you first -
April 8th 2008 6 month AST started, going to periodic after this
April 2012 renewed for 12 months
Notice emailed to me May 10th 2012 but Tenant called to try and back date. I accepted via email but stated correct leaving dates (one full tenancy month so 8th July) T replied saying unfair and they think its wrong but will be taking advice. No further communication in this regard. T states that they are picking up keys to council flat in two days!
Tenant stops paying
Email from T ref outstanding property repairs that they said they had written to us about two months prior but I hadn't received. Also requested communication via post not email.
Several letters posted (with proof of post) ref access to inspect/get quotes for works needed and rent arrears - none answered
Copied guarantor on all communications incl emailing PDF of letters
Emailed G ref no replies from T and asking intentions ref debt (G has bailed T out last year)
Emailed G asking for reply to emails (busy guy but usually responds after a day or so but nothing this time)
So now to a couple of questions -
Does the tenant HAVE to leave as they have given notice?
Can we just enter the property on the date WE believe the tenancy has ended if we don't hear from them?
Found G's address (I think) should we send a letter before action to them (I did promise in an email that I would inform them before taking any action) - would we have to send this LBA to T and G jointly?
If (when) we continue with a legal claim/action can we do so just with the G as T has no job/money and G is a London surgeon?
PS Docs G signed were separate to AST and witnessed (standard Countrywide Residential Lettings type stuff on a tenant find basis)
