We are a sharehold of freehold block of 8 flats. The ground floor flat is under offer and there is a very small piece of land that only they can access from their flat.
It has now been discovered that the land is not demised to the flat. The buyers wish to have it demised To the flat.
The directors of the company are happy to get an independent valuation and sell the said piece of land to the flat and get a deed of variation drawn up. One director has asked if we need to ge the consent of all the leaseholders first. Do we have to seek approval from all the leaseholders or can the directors make the decision?
