Overcrowded HMO due to guest moving in

A tenant has moved his girlfriend in after having regularly been told (verbally, in writing and by email) it is not possible for his girlfriend to live in the 3 storey house as it is not licensed for a 5th person. It was only because the other tenants told me that I found out as she rarely leaves the room. (It is an ensuite). I have applied to the council for a temporary exemption notice and given the tenant a section 21 notice.
As a matter of interest for other tenants - when does a visitor become permanent?
How is it possible to word the AST to prevent people staying illegally and yet avoid unfair terms and conditions? I see some suggest 3 days but they could return after a day away and stay another 3 days...
Do I have a right to inspect the individual room?
Is it possible to evict within the 2 months given the breach of contract, and given that I only found out just after the beginning of a new month on his contract which makes it nearly 3 months.
