RTM company and debt collection fees

I've been struggling with a leaseholder who doesn't like paying service charges.

We gave the leaseholder the option to pay in monthly installments which he did for a few months after I initially threatened him with a CCJ but then he stopped again.

This time I was looking at using a debt collection agency as this way I may be able to force him to co-operate with me. The problem is the agency tends to charge a fee which the RTM company would have to pay.

Under the lease I believe I can add the cost of the legal costs to the service charge but this would be divided amongst all leaseholders which seems a bit unfair.

I think I already know the answer to this, but can I charge the debt collection fee directly back to the leaseholder who is not paying?

Someone also suggested that I could contact the mortgage company directly and inform them that they are not paying service charges as they are also liable for them. They will in turn add the debt to the mortgage if the leaseholder still refuses to pay. Is this really an option or is that only an option when the freeholder can step in on the breach of the lease and threaten to end the lease?
