Rear Yard Boundary Fence

Hi,

I bought a rental property a number of years ago; there is a communal pathway runing behind the property separating the rear yard. I acquired the rear yard by applying to the land registry for absolute possession; the previous owner had looked after this land for over 12 years. My neighbours either side had already gained absolute possession of the yards behind their properties. I contacted the land registry to confirm who was legally responsible for the fences either side of my yard.

After a search of the deeds, the land registry said the border fences either side were joint responsibility. One of the fences has collapsed. I have made several phone calls to the owner, who subsequently also owns an estate agent and letting agency. He has not replied. I have written a letter explaining the situation and sent it by recorded post, still no reply. I don’t want to fix the fence incase it sets a precedence.

Any ideas?
