I have just started renting my property out and now into the second month. I originally signed for a tenant find only but the agency offered a zero fee full management service for the year as a trial so I signed the contract.
I have been chasing them for the DPS reference, signed contract and signed inventory list but have been fobbed off every time, the last excuse was that they only had 1 copy and the scanner had broke so will post when its fixed.
The tenant moved in at the beginning of March but both of my payments have been coming in around the 10th.
It is to my surprise today after visiting the tenant for a repair job that he is still waiting for the DPS reference, has never received an inventory list and actually paid the agency the whole 12 months rent. The 12 month up front payment was the tenants suggestion to guarantee the place although it wasn't necessary.
I plan on going to their office to talk to them directly but what is my legal situation? I guess I can terminate the contract if neither the DPS or inventory list was carried out but I am concerned I may never see the rent. Can they hold it and pay monthly amounts or are they obliged to transfer the whole amount over?
