NIGHTMARE Street trading license for a takeway

Hi all,

I am the chairman of a small (15) block of flats. We collectively own the freehold. The flats are in a conservation area. The building is not listed (converted 60's office block) the boundary wall aroud the flats is as it adjoins a street that is listed.

There is a parcel of land that was handed over to the council in 1961 the deed cover sheet states it can be used for public access. (the land registry cannot find the actual deed). The land is situated at the front of the block outside of the boudary wall. One elevation of the flats backs directly onto this parcel/pavement of land. Several bedroom windows also open out onto this land.

Over the past ten years we have had a constant battle to rid the area of a kebab van and its associated grief. The council keep letting people apply to also put a van at the front of our building. To date we have managed to stop this by stating noise, antisocial behaviour etc. Some leaseholders have complained about the noise eminating from the existing van and how their properties are proving difficult to rent and sell.

Does anyone have some strong paragraphs I can send with a set of objections to stop the council and the applicants in their tracks?
